Where the firm accepts matters

One chambers in Jaipur, and matters accepted across India in association with local counsel.

Riva Legal Associates works from a single chambers in Jaipur, Rajasthan. It does not maintain offices elsewhere. Matters are accepted from clients across India, and where a matter requires appearance before a court or tribunal in another state, the firm associates local counsel who appears on the record while the firm conducts the matter.

Much of the firm’s work does not depend on location at all. Intellectual property registries file and prosecute electronically and hear by video conference; tax assessment and first appeal are faceless; drafting, advisory and diligence are document work. What does depend on location is which registry, tribunal or regulator governs a particular matter — and that varies more than most businesses expect. The pages below set out the position city by city.

The same question, nine different answers

Indian intellectual property registries divide the country on different lines from one another, and the tribunals divide it differently again. A business does not deal with one office; it deals with several, in several cities. This table shows how far apart those answers are for the same three questions.

City Trade marks Patents High Court
Jaipur Ahmedabad New Delhi Rajasthan
Mumbai Mumbai Mumbai Bombay
Pune Mumbai Mumbai Bombay
Bengaluru Chennai Chennai Karnataka
Hyderabad Chennai Chennai Telangana
Delhi New Delhi New Delhi Delhi
Kolkata Kolkata Kolkata Calcutta
Chennai Chennai Chennai Madras
Lucknow New Delhi New Delhi Allahabad

Jaipur is the clearest illustration. A Rajasthan applicant files trade marks at Ahmedabad and patents at Delhi — two registries, two cities, one business. Designs are examined at Kolkata for the whole of India, copyright is filed at New Delhi, and geographical indications at Chennai, wherever the applicant is. Trade secrets have no registry at all.

How pan-India work is conducted

A substantial part of the firm’s work is not tied to any location. All five intellectual property registries file and prosecute electronically through the CGPDTM and Copyright Office portals, and hearings before them are ordinarily held by video conference. Income tax assessment and first appeal are conducted under the faceless regime through the department’s portal. Company filings are made through the MCA portal. Drafting, structuring, due diligence and advisory work is document work.

What does require local presence is appearance before a court or tribunal. Where a matter requires that in a state other than Rajasthan, the firm associates local counsel who appears on the record, while the firm continues to conduct the matter itself — pleadings, evidence, strategy and instructions throughout. This is the ordinary way pan-India litigation is conducted in India, and it is how the firm has structured its practice rather than opening offices it would not be able to staff properly.

An initial consultation is arranged on request to understand the matter and the assistance sought. There is no fee for that conversation. If the firm is in a position to assist, an engagement letter setting out the scope of work and the terms is shared before any work begins. The firm does not disclose its fees on this website.
